No, Indiana is not a no-fault state. If you cause a car accident, the other driver will file a car accident claim with your insurance provider.
This means that if you were found to be at-fault for the accident, your insurance provider will cover the other driver’s accident-related bills, including the other driver’s and their passenger’s injuries. However, to pay for your and your passenger’s injuries an optional medical payment coverage add-on will be needed.
Remember that fault isn’t an all-or-nothing deal; sometimes, in an accident, fault can be shared between the drivers. In Indiana, you only collect damages from the accident if you are
found to be less than 51% responsible
(or at-fault) for the accident.
If you don’t have insurance, the not at fault driver can file a lawsuit against you to recover these damages.
