Can you go to jail for drinking and driving?

Is there a chance that I’ll go to jail for a DUI in Maine? I got pulled over, and I was just over the legal limit, and now I’m so worried about what’s going to happen to me. I don’t want to have jail time on my record!

You could go to jail for drinking and driving in the state of Maine, even if this is your first offense. The charge is considered a class D crime, meaning you could go to jail for up to one full year for this type of charge.
There are also extenuating circumstances that make a jail sentence of at least 48 hours mandatory. These conditions are:
  • Your BAC was 0.15 or higher.
  • You were speeding by 30 MPH or more or tried to evade the police.
  • You were driving with someone under 21.
Maine also charges a $500 to $2,000 fine and
suspends your license
for 150 days when you’re convicted of drinking and driving.
