Exceptions to Delaware’s motorcycle helmet law

If you are 19 years of age or older, you are not legally required to wear a motorcycle helmet in Delaware. 
Vehicles similar in design to motorcycles may not be subject to following motorcycle helmet law. If you are riding a motorized scooter, a bicycle helmet is considered adequate protection.
Additionally, if you are 17 years of age or older and ride a two-wheeled moped, you must meet either of the following two conditions to be exempt from Delaware’s helmet law: 
  • The moped must have a displacement of less than 55 cc or 
  • The moped must have an electric motor rated between 751 and 2,000 watts. 

Penalties for breaking Delaware’s motorcycle helmet law

While there are no fixed penalties for breaking motorcycle helmet laws, first-time offenders under 18 years of age and younger could face a $25 to $115 fine
