I’m sorry you got pulled over during your visit to the Lone Star State! According to the Texas Transportation Code (Sec. 545.413), any passenger over the age of 15 not wearing a safety belt is guilty of a misdemeanor.
There are only a few ways to get a no-seatbelt ticket dismissed. You must present proof that:
You have a medical reason not to wear a seatbelt
You’re employed by the United States Postal Service, a utility company, or a solid waste transportation service
You were delivering newspapers or operating a commercial farm vehicle at the time of the offense
If you received a ticket for transporting a child without a seatbelt, the ticket price will increase to $100-$200. Again, there aren’t many ways to fight it. In most cases, it’s best to just pay the ticket and learn from your mistakes.
