Can an HOA change their rules after purchase?

I’m considering purchasing a home in a community with an HOA. I checked their rules and they’re a bit strict for my taste, but I could make it work. I’m just worried they’ll get worse! Can an HOA change their rules after purchase?

I totally understand your hesitation—your lifestyle matters. It might not be what you want to hear, but the answer is yes, an HOA can change their rules and even create new rules and regulations.
Your HOA should have a set of governing documents that determines the process for changing and creating rules. In some HOAs, for example, the board must notify the owners and/or allow the owners to vote on a new rule before it is implemented.
Most HOAs can establish new regulations, including pet restrictions, as long as they follow the proper processes and the rules do not violate federal or state law. A new rule, for example, cannot be in violation of the Federal Fair Housing Act.
The Federal Fair Housing Act prohibits discrimination on the basis of:
  • Race
  • Religion
  • Sex
  • National origin
  • Disability
In many cases, rules will not change without the support of the community. Occasionally, a new regulation will include an exemption, allowing you to “grandfather” in something you were previously permitted to do.
