How do you deal with insurance adjusters after a car accident?

What should you say or not say when speaking with an insurance adjuster? This is my first time speaking with an adjuster after a car accident. I’ve heard bits and pieces of what I should do but it’s all very confusing to me.

When it comes to speaking with adjusters, there is an endless list of advice and it can be very confusing! Keep in mind that law firms want you to enlist their help in battling insurance companies because they stand to make a profit. So much of their advice is biased.
However, that doesn’t mean you shouldn’t exercise caution when dealing with insurance adjusters after a car accident—especially if you’re speaking to the adjuster from the other driver’s insurance company.
In contrast, when you’re talking to the adjuster from your insurance company, you will need to give them as much information as possible. Withholding information can cause a delay or possible denial of your claim.
Another thing to remember is that most insurance claims are settled directly with the insurance companies and don’t need outside intervention. Any reputable insurance company wants to solve the insurance claim as quickly and fairly as possible. Lawsuits are costly for everyone and delay the whole process.
If you are in a situation where a
lawyer is involved
, you will need to be cautious about what you do and don’t say; however, it is your lawyer’s job to guide you through this process.
Here are some of the do’s and don’ts your lawyer may advise:
  • Remain calm and polite
  • Identify the person you speak with
  • Give limited personal information
  • Do not give full details of the accident
  • Take notes
  • Resist settling immediately
  • Set limits on conversations
  • Refuse to give recorded statements
