Eligibility: Jerry Survey Giveaway (the “Giveaway”) is open to legal residents of all fifty (50) United States and the District of Columbia who are of the age of majority in their state of residence at the time of entry. Employees, independent contractors, interns, officers, directors, and agents of Jerry Services, Inc. (“Sponsor”), its affiliates, subsidiaries, and agencies (collectively “Promotion Parties”), and members of their immediate family or persons living in the same household are not eligible. The Giveaway is subject to all applicable federal, state, and local laws, rules, and regulations and is void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Terms and Conditions. Sponsor’s decisions are final and binding in all matters related to the Giveaway. Winning a prize is contingent upon fulfilling all requirements set forth herein.
Giveaway Period: The survey will be distributed by 12:00 a.m. Pacific Time (PT) on May 21, 2024 with final entries being completed by 11:59 p.m. Pacific Time (PT) on June 17, 2024 (the “Giveaway Period”). All entries must be received during the Giveaway Period and meet other requirements in these Terms and Conditions to be eligible to win a prize. Sponsor’s or its designee’s computer is the official time-keeping device for the Giveaway.
How to Enter: You can enter the Giveaway by completing the research survey sent by Sponsor to participants. You may receive a maximum of one (1) Giveaway entry during the entire Giveaway Period. Multiple entrants are not permitted to share the same phone number. Use of any robotic, automatic, programmed, or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification. You may not enter more times than indicated by using multiple phone numbers, identities, or devices in an attempt to circumvent the rules. In the event of a dispute as to any submission, the authorized account holder of the phone number used to register will be deemed to be the entrant. The “authorized account holder” is the natural person assigned a valid phone number by a network service provider or other organization responsible for assigning phone numbers. Each potential winner may be required to show proof of being an authorized account holder.
Drawing: A random drawing will be conducted on or about June 24, 2024 by Sponsor or its designated representative to select one (1) prize winner from among all eligible entries received. Odds of winning depend on the number of eligible entries received during the Giveaway period. Potential winner will be notified via SMS and/or phone call and must sign and return any required Affidavit of Eligibility and Release within five (5) days of the date notice is sent or such other date set by Sponsor. Failure to respond within the applicable time period will result in forfeiture of prize and Sponsor shall have the option to award the prize to an alternate winner. The return of any prize notification or prize as undeliverable may result in disqualification and an alternate winner may be selected by random drawing from among all remaining eligible entries. Only three (3) alternate drawings will be held, after which the prize will remain un-awarded.
Prize: One (1) winner will be awarded the following prize: Amazon gift card. Total prize value: $100. Prize consists of only those items specifically listed as part of the prize. PRIZE WILL BE ACCEPTED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE). Promotion Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to a prize, including express warranties provided exclusively by a prize manufacturer that may be sent along with a prize. All applicable taxes resulting from acceptance of the prize are the responsibility of the winner. No prize substitution, cash substitution, or assignment or transfer of prize is permitted, except by Sponsor for reason of unavailability in which case a prize of equal or greater value will be awarded. Acceptance of a prize also constitutes permission to the Promotion Parties to use the winner’s name for regulatory and marketing purposes without further compensation or right of approval, unless prohibited by law.
Limitation of Liability: To the fullest extent permitted by applicable law, by entering this Giveaway, entrants waive all right to, and hold the Promotion Parties harmless from, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys’ fees) arising out of or in connection with participation in this Giveaway or the acceptance, use, or misuse of any prize. Promotion Parties will not be responsible for: late, incomplete, or incorrect entries; an entrant’s failure to receive prize notices due to entrant’s spam, junk e-mail, or other security settings or for entrants’ provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this Giveaway; by any human error which may occur in the processing of the entries in this Giveaway; or any typographical, technological, or other error in the publishing of the offer, administration of the Giveaway, or announcement of the prize. If, in the Sponsor’s opinion, there is such an error, or there is any suspected evidence of tampering with any portion of the Giveaway, or if technical difficulties (including viruses and bugs) compromise the integrity of the Giveaway, Sponsor reserves the right to, in its sole discretion, cancel or modify this Giveaway in an appropriate manner. In the event of termination, a winner will be selected from among all eligible entries received as of date of termination.
Choice of Law and Forum: Entrant agrees that all matters arising out of or relating to this Giveaway and these Terms and Conditions are governed by, and construed in accordance with, the laws of the State of California, without giving effect to any of its conflict of laws provisions thereof. Entrant further agrees that any legal suit, action, or proceeding arising out of or relating to this Giveaway and these Terms and Conditions shall be brought exclusively in the applicable federal or state courts located in Santa Clara, California.
Privacy: Information submitted with an entry is subject to the Privacy Policy stated on https://getjerry.com/privacy-policy.
Winner List: For the name of the prize winner, email a request to hi@getjerry.com, with “Jerry Survey Giveaway Winner Inquiry” in the subject line, after the winner selection date and before three months after the winner selection date.
