Why am I at fault when someone hit me in a parking lot?

I was going through a parking lot when a car backed out into me. I have to submit a claim to my insurance even though I don't think I'm at fault. Why?

In most cases, if both vehicles are moving, they share fault. If only one vehicle is moving, the moving vehicle is at fault.

. In this case, neither party is at fault, and both have to submit claims to their insurance. By submitting a claim, you may have to pay your

deductible to cover damage to your vehicle.
While it may not seem fair, it prevents you from having to settle in court or negotiate with the other driver’s insurance company.
