Who pays for damage caused by a stolen car?

I was sideswiped by a speeding car that evaded the scene after the collision. I was informed by police that the driver was apprehended and it was discovered that the car that hit me was stolen—who pays for the damage?

Who pays for damage caused by a stolen car depends on a few factors—namely, the types of insurance coverage you carry.
  • If you have uninsured motorist coverage or comprehensive coverage, you can file a claim with your insurance company and collect for the damage.
  • Collision coverage will pay for any repairs that are needed for your vehicle—but won’t cover medical bills you’re left with as a result of the incident.
  • If you’re only carrying the minimum liability insurance
    required by your state
    , you’ll be tasked with paying for the damage without the help of your insurance provider.
Note that in order to receive any reimbursement from your insurance company, you first must pay a deductible, as well.
The insurance provider for the owner of the stolen vehicle is not responsible for covering any of the damages incurred in the accident because the car was taken without consent. If the car thief is arrested for the offense, you may be able to seek restitution as part of the terms of their criminal sentencing.
