Who gets the car in a divorce in Alabama?

My (ex) spouse and I have shared a car for the duration of the marriage, but the title's in his name. I've been using the vehicle to commute to work. Will I have any claim to it after the divorce?

“Alabama is an equal distribution state, which means when it comes to your marital community property (like a car), you will split equity but not necessarily get exactly half of everything.
For example, if you have $10,000 of equity invested in the vehicle during your marriage, you each should get around $5000, but one of you may decide to keep the car while the other gets $5,000 of value from another asset.
Equal distribution only applies when parties don’t come to a separate agreement about assets. So if your spouse agrees that you can keep the vehicle, all you’ll need to do is transfer the title, registration, and car insurance into your name.
In the meantime, if you don’t have access to the vehicle, you may consider leasing, so that you don’t put equity into another asset before the divorce is finalized.
While it adds another thing to think about during your divorce, you should consider reviewing your insurance policy. If you and your spouse need to get separate policies, it’s a good time to shop for the best rates.
