If all drivers are required to carry bodily injury liability, when would you need to submit a PIP claim?
“Whether your bodily injury liability or personal injury protection is used depends on the situation.
If you’re at fault in an accident, you would only be able to submit a personal injury (PIP) claim. Since PIP provides coverage regardless of fault, you’d cover your own medical expenses with it.
To cover the other driver’s injuries, they would submit a claim to your insurance for your bodily injury liability.
If the other driver is at fault and you’re injured, you would submit a claim to their insurance for bodily injury and you can submit a claim to your insurance for PIP.
Submitting a PIP claim when you’re not at fault ensures that you have coverage for any immediate medical expenses you may have until the other driver’s insurance pays out.”
