My kid thinks that now that they have their license, they can stay out as late as they want. That’s not the case regardless of what the law says, but I want to prove a point. What is the nighttime curfew for teen drivers in Virginia?

More specifically, Virginia law says no license holder under the age of 18 can drive a vehicle between midnight and 4:00 a.m. This may provide a reasonable cut-off time for your teenager’s social outings, depending on your household rules.
If there are certain times that your young driver will need to drive later, however, the law does provide exceptions. The curfew can be waived when driving:
  • To or from a place of employment
  • To or from an adult-lead activity sponsored by a school, civic, religious, or public organization
  • With a licensed spouse, parent, or guardian age 18 or older in the front passenger seat
  • In case of an emergency
