My friends are always saying I drive too fast and risk getting charged with reckless driving. But I usually follow the speed limit, except when others are speeding too. What is considered reckless driving in Arizona?

Statute ARS 28-63 defines what is considered reckless driving in Arizona as “a person who drives a vehicle in reckless disregard for the safety of persons or property.” Since this definition is a bit vague, it may be helpful to unpack.
Some examples of reckless driving in Arizona include:
  • Speeding through a crowded neighborhood
  • Swerving between cars in heavy traffic
  • Tailgating another car while driving above the speed limit
A reckless driving conviction is considered a Class 2 misdemeanor in Arizona and can result in jail time of up to four months, a maximum fine of $750, license suspension, or some combination of these punishments.
