Is Indiana an at-fault state?

Last week, I was in a fender bender that was my fault. I live in Indiana. Will I have to pay for the damages or does the other driver’s insurance pay?

Sorry to hear you were in an accident!
Indiana
is an at-fault state. This means that, since you were responsible for the accident, according to
Indiana car accident laws
, you will have to pay for the other driver’s damages.
Let’s discuss the difference between at-fault and no-fault states:
  • In an at-fault state, or a tort state, the driver who caused the accident pays for the other driver’s property damage resulting from a collision.
  • In a no-fault state, both parties turn to their respective insurers for medical expenses resulting from an accident, but the at-fault driver is typically still liable for paying for the other driver’s property damage.
There are twelve no-fault states. They are:
  • Florida
  • Hawaii
  • Kansas
  • Kentucky
  • Massachusetts
  • Michigan
  • Minnesota
  • New Jersey
  • New York
  • North Dakota
  • Pennsylvania
  • Utah
It’s always a good idea to have more than the
state minimum car insurance
protection. For more coverage in future collisions, consider opting for
full coverage insurance
. An at-fault accident will undoubtedly increase your insurance costs.
