Is an open container a moving violation?

Will I get a moving violation on my record for having an open container in the back of my car? I don’t understand how open container laws compare to other traffic laws.

No, an open container is not considered a moving violation in any state other than North Carolina, where the
open container laws
are slightly different.
However, that’s not to say that this isn’t a serious charge! Having an open container of alcohol in your vehicle while you’re driving is considered a misdemeanor in most states, meaning you could get jail time for this offense.
Most states make an exception for partially consumed bottles of wine, but an open bottle of liquor will almost always result in a misdemeanor charge. To avoid this charge, you’ll need to be sure that the alcohol is sealed in its original container.
