How long will a DUI stay on my driving record in North Dakota?

I was at a party in Fargo and made a very bad error in judgment. I thought I was sober enough to drive home, but apparently I was not because here I am with my first DUI conviction. I’m very concerned—how long am I going to have a DUI on my driving record in North Dakota?

You aren’t the only driver who made a bad call and ended up driving drunk. Remember, you don’t even technically need to blow .08 BAC to be convicted for impaired driving—so if you’re questioning your ability to drive, that’s always your cue to call a cab or Uber.
That said, a DUI will stay on your driving record in
North Dakota
for a minimum of seven years.
This is what’s called a look-back period and is used in court to determine how future DUI charges will be penalized. In North Dakota, look-back periods for DUI convictions are as follows:
  • First, second, and third offenses—seven year look-back period
  • Fourth and subsequent offenses—fifteen year look-back period
Essentially, how this works is if you get caught drunk driving in
Fargo
again six years from now, the charge will be counted as your second offense and you will face higher penalties. However, if you were caught driving drunk twelve years from now, it would only count as a first offense.
In terms of your criminal record, you can seal your DUI conviction after seven years or more have passed, as well—so long as you haven’t had any convictions since then.
Getting a DUI can be a huge wake up call—one that comes with a loss of driving privileges, hefty fines, and
much higher insurance rates
