How long will a DUI stay on my driving record in New York?
I stupidly tried to drive back from Chippewa after clubbing one night and now I’m officially convicted with my first DUI. I’m worried this will limit me from crossing the border for a long time. How long will I have a DUI on my New York driving record?
Answer provided by
- DWAI (driving while alcohol impaired)—your BAC was between .05 and .07, the conviction stays on your driving record ten years
- DWI (driving while intoxicated)—your BAC was .08 or over, the conviction stays on your driving record fifteen years
- You can sometimes apply for a Temporary Resident Permit (TRP) that will allow limited entry with valid reason
- You can apply for Criminal Rehabilitation (CR) which will forgive your conviction—but you can only apply for this five years after your conviction
