How can I sue a car dealership?

The dealership told me that the car I bought had never been in an accident, but I learned from a car history report that it was in a big accident that caused a lot of damage. This makes me think that there could be other problems with the car, and I probably paid too much for it. What do I need to do to sue a car dealership?

That sounds so frustrating! Fortunately, you may be able to recoup some of your losses or get a favorable ruling when you sue a car dealership. To sue the dealership, you have three basic options:
  • Find an auto fraud attorney to help you with your case.
  • If your car has significant operating problems, you may be able to sue for violation of your state’s
    lemon laws
    .
  • You can also sue for misrepresentation since your dealer failed to disclose important facts about the car before you bought it.
Your state law may also require you to contact the dealership first so that they have an opportunity to correct the error. You may also be entitled to certain remedies, such as:
  • Returning the car for a full refund
  • Cancellation of outstanding loans
  • Reimbursement for attorney or legal fees
Keep in mind that a full lawsuit may gain you a more favorable settlement, but you can also lose money on lawyer and court fees. Lawsuits can also be very stressful and time-consuming. If you’re able to, consider settling the matter outside of court to save yourself some stress, time, and money.
