What happens if you get a speeding ticket in North Dakota?

When you are pulled over for speeding in North Dakota, the officer will ask for your license and registration, then write you a citation. You can receive a speeding ticket for exceeding an absolute speed limit or driving in violation of the basic speeding law.
The absolute speed limit is the maximum speed you can lawfully drive on a roadway. This is the speed indicated on the signs you see on highways, business and residential areas, and school zones. Absolute speed limits vary from state to state, but in North Dakota they are:
  • 75 miles per hour on access-controlled, paved, and divided, multilane interstate highways
  • 70 miles per hour on paved and divided multilane highways
  • 65 miles per hour on paved two-lane highways
  • 55 miles per hour on gravel, dirt, or loose surface highways, and on paved two-lane county and township highways if no speed limit is posted
  • 25 miles per hour on any highway in a business district, residential district, or near a public park
  • 20 miles per hour in a posted school zone or when a driver’s visibility is obstructed
The basic speed law prohibits driving at an unreasonable speed given existing circumstances and potential hazards. If your speed is considered unsafe you can receive a speeding ticket in violation of basic speed law, even if you are not exceeding the posted speed limit.
If you are issued a citation for speeding, the police officer will write you a ticket with the fine amount and provide you an envelope with the country courthouse address.
Be sure to pay for or respond to your traffic citation within 14 days of receiving it or you’ll face additional fines and penalties.

What are the fines for a speeding ticket in North Dakota?

The amount you are fined will be determined by which speeding law you violated. While the fine for violating North Dakota’s basic speeding law is set at $30, the fines for exceeding an absolute speed limit depend on the driver’s speed.
Ticket
Fine amount
1 - 5 mph over speed limit
$5 plus $1 for each mph in excess of five mph that the driver exceeds the limit
6 - 10 mph over speed limit
$5 plus $1 for each mph in excess of five mph that the driver exceeds the limit
11 - 15 mph over speed limit
$10 plus $1 for each mph in excess of ten mph that the driver exceeds the limit
16 - 20 mph over speed limit
Fine of $15 plus $2 for each mph in excess of 15 mph that the driver exceeds the limit
21 - 25 mph over speed limit
$25 plus $3 for each mph in excess of 20 mph that the driver exceeds the limit
26 - 35 mph over speed limit
$40 plus $3 for each mph in excess of 25 mph that the driver exceeds the limit
36 - 45 mph over speed limit
$70 plus $3 for each mph in excess of 35 mph that the driver exceeds the limit
46+ mph over speed limit
$100 plus $5 for each mph in excess of 45 mph that the driver exceeds the limit
Additional fines apply for absolute speed violations on highways with posted speed limits above 55 miles per hour. Driving 1 to 10 mph above the limit will cost $2 for each mph you are over. If you are driving 11 mph or more above the speed limit, you’ll be fined $20 plus $5 for each mph over.

Options for dealing with a speeding ticket in North Dakota

If you’ve been issued a speeding ticket in North Dakota, you have two options to handle it—pay the fine or contest it in court.

How to pay a speeding ticket in North Dakota

You can pay your citation via mail in the envelope provided or pay online with a credit card through the North Dakota State Court’s website.
If you want to pay by mail, send the payment to the Clerk of the District Court in the envelope provided. The specific courthouse address will be listed on the envelope.
Paying your citation in full will close your case, and the ticket will appear on your driving record. Additional points will be added determined by the severity of your offense.

How to fight a speeding ticket in North Dakota

If you can’t afford to pay the fine and don’t want additional points on your record, then you’ll have to request a court hearing to fight your speeding ticket.
To contest the speeding charges sign and date the ticket in the appropriate sections and mail your bond payment in the envelope provided.
Signing the citation and mailing the payment is an agreement to appear in court on your assigned hearing date. If you fail to appear in court, a warrant will be issued for your arrest and your driver’s license may be suspended.
If the court finds you not guilty, your bond will be returned, and all charges will be dismissed as well as any fines or penalties. If convicted, you will have to pay same-day fines, and additional points will be added to your driving record.

Will a speeding ticket increase your insurance?

A speeding ticket conviction will add penalty points to your record and increase your insurance premium. The average cost of insurance increased by 17 to 18 percent for North Dakota drivers with penalty points on their record.
